2. Collection and storing of personal data and nature and purpose of their use

a) Visiting our website
When you visit our website www.drschenk.com, www.schenkvision.com and www.drschenkasia.com, the bowser used in your device automatically sends information to the server on which our website is located. The following information is gathered and stored temporarily until its final deletion in a so-called log file:

  • IP address of requesting device
  • Date and time of access
  • Name and URL of the requested file,
  • Website from which the access occurred (referrer URL),
  • Browser and operating system in use on your device as well as name of your access provider.

We collect these data for the following purposes:

  • Assure unobstructed connection establishment with the website
  • Assure convenient use of our website
  • Analysis of system security and stability
  • Further administrative purposes.

The legal foundation for this collection of data is Article 6, Section 1, Sentence 1, lit. (f) GDPR. Our legitimate interest stems from the purposes for data collection as listed above. We do not use your personal data for the purpose of drawing conclusions about your person. Furthermore, we use cookies and analysis services on our website. More information regarding this can be found in Sections 4. and 5. of this data privacy statement.

b) Using our contact form
You can contact us by using a contact form provided on our website. This requires you to enter your given name and family name, company name and a valid email address so we know by whom the inquiry was sent and respond to it. You have the option of entering additional information. Data processing for the purpose of contacting us is done according to Article 6, Section 1, Sentence 1, lit. (a) GDPR with your voluntarily provided consent. The personal data collected in connection with using our contact form are deleted automatically after your inquiry has been processed.

 

3. Transfer of data
We do not transmit your personal data to third parties except for the purposes listed below. We only transmit your personal data to third parties if and when:

  • You have given your explicit consent according to Article 6, Section 1, Sentence 1, lit (a) GDPR
  • Transmitting is necessary in order to enforce, exercise or defend legal claims according to Article 6, Section 1, Sentence 1, lit (f) GDPR and there is no reason to suspect that you have an overriding interest to retain your data
  • There is a legal obligation to transmit the data according to Article 6, Section 1, Sentence 1, lit (c) GDPR, and
  • This is permitted by law and according to Article 6, Section 1, Sentence 1, lit. (b) GDPR is necessary to manage contracts with you.

 

4. Cookies
We use cookies on our website. These are small files which are automatically created by your browser and saved on your device (laptop, tablet, smart phone, etc.) when you visit our website. Cookies do not cause any harm in your device they do not contain any malware. The cookie contains information related to the specific device. This does not mean however that we thereby gain direct knowledge of your identity. The use of cookies serves the purpose of making our website more convenient for you. We use so-called session cookies to identify which pages of our website you visited. After you leave our website these cookies are automatically deleted again. In addition, we use temporary cookies that are stored on your device for a certain time. When you revisit our site, this cookie will recognize that you have visited before and which settings and entries you used so you do not have to reenter this information. Furthermore, we use cookies to create statistics regarding the use of our website and analyse this data to optimize the site for you (see number 5.). These cookies enable us to see that you are a recurring visitor to our website. They are deleted automatically after a certain defined time. The data processed through cookies are necessary to safeguard our interests and the interests of others according to Article 6, Section 1, lit. (f) GDPR. Most browsers accept cookies automatically. You have the option however to configure your browser in such a way that cookies are not stored on our device or a notice appears before a new cookie is created. Disabling cookies completely however may result in you not being able to use all functions of our website.   

 

5. Analysis tools / tracking tools
The tracking measures listed in the following subsections are performed according to Article 6, Section 1, lit (f) GDPR. By employing them we wish to make sure our website meets the demands of the visitors and continuously optimize it. Furthermore, we use tracking measures to capture the use of our website statistically and analyze this data to optimize our offer to you. These interests are considered legitimate according to the aforementioned regulation. The respective purpose of processing the data and the categories of data can be found in the corresponding tracking tool description.

a) Google Analytics
To meet the requirements of the visitors and for the continued optimization of our website we use Google Analytics, a web analysis service of Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereafter „Google“). In this context pseudonymized user profiles and cookies (see Section 4.) are created. The data created by the cookie regarding your use of our website, for example

  • Browser type / version,
  • Operating system is use,
  • Referrer-URL (previously visited web page),
  • Host name of the device accessing the site (IP address),
  • Time of server request,

are transferred to and saved on a server of Google in the USA. The information is used to analyse the use of the website, to create reports about the website activity and to enable other services connected with the use of the website and the use of the internet for the purpose of market research and design of the web pages to meet the visitors’ demands. This information may be passed on to third parties if this is legally required or insofar as these third parties process information on Google’s behalf. In no case is your personal information consolidated with other data from Google. The IP addresses are anonymized so that mapping is not possible (IP masking). You can prevent installation of these cookies be setting your browser accordingly. We point out though that this may result in you not being able to use all the features of our website. You can furthermore prevent the cookie form collecting data related to your use of the website (including your IP-address) as well as the processing of this data by Google by downloading and installing a browser add-on ( https://tools.google.com/dlpage/gaoptout?hl=en). As an alternative to the browser add-on, especially with browsers on mobile devices, you can prevent the collection of data by Google Analytics by clicking on this link. This will create an opt-out cookie which prevents the collection of your data for future visits to our website. The opt-out cookie is only valid for the specific browser and only for our website. It will be stored in your device. When you delete cookies in your device you have to recreate the opt-out cookie. b) Google AdWords Conversion Tracking
To statistically capture the use of our website and for its continued optimization we occasionally use Google AdWords Conversion Tracking. To this end a cookie (see Section 4.) is created in your device by Google AdWords, if and when you reached our website via a Google AdWords advertisement. These cookies are valid for 30 days and do not serve the purpose of personal identification. If the user visits certain pages of the AdWords customer and the cookie has not yet expired, Google and the customer can detect that the user clicked on the advertisement and was forwarded to this web page. Every AdWords user receives a different cookie. Cookies can therefore not be tracked via AdWords customer websites. The data gathered through the conversion cookie serve the purpose of creating conversion statistics for AdWords customers who have chosen conversion tracking. The AdWords customers find out about the total number of visitors who have clicked on their advertisement and were forwarded to a page equipped with a conversion tracking tag. They do not however receive information with which the user is identified. If you do not wish to participate in the tracking process you can reject the required cookie – for example via a setting in your browser that will generally deactivate automatic installment of cookies. You can also deactivate cookies for conversion tracking by setting your browser to block cookies originating from the domain “www.googleadservices.com“. 6. Your rights as data subject
According to the GDPR you have the following rights:

  • Right of confirmation and access regarding your personal data which is being processed by us according to Article 15 GDPR. In particular you can obtain information regarding the purposes of processing; the categories of personal data concerned; the categories of recipients concerned to whom the personal data have been or will be disclosed; the envisaged period for which the personal data will be stored; rectification or erasure of personal data or restriction of processing from us or to object to such processing; right to lodge a complaint with a supervisory authority, and where the personal data are not collected from the data subject any available information as to their source; the existence of automated decision-making, including profiling and significance and the envisaged consequences of such processing
  • Right of rectification without undue delay according to Article 16 GDPR regarding inaccurate or incomplete personal data
  • Right to erasure (”right to be forgotten“) according to Article 17 GDPR, unless processing is necessary to ensure freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for establishment, exercise or defense of legal claims;
  • Right to restriction of processing according to Article 18 GDPR, if you contest the accuracy of the data, the processing is unlawful and you oppose erasure of the data and we no longer need the data but you require them for the establishment, exercise or defense of legal claims or you have objected to processing pursuant to Article 21, Section 1 GDPR pending verification whether our legitimate grounds override yours;
  • Right to data portability according to Article 20 GDPR regarding your data with which you have provided us in a structured, commonly used and machine-readable format and transmit those data to another controller as far as this is technically feasible;
  • Right to withdraw consent according to Article 7 Section 3 GDPR; you can withdraw your previously given consent at any time; as a consequence we shall from then onward not be permitted to process your data any further;
  • Right to lodge a complaint with a supervisory authority according to Article 77 GDPR; you can generally contact a supervisory authority of your habitual residence, place of work or our company headquarters.

 

7. Right to object
Inasmuch as your personal data is processed with legitimate interest according to Article 6, Sentence 1, lit (f) GDPR you have the right to object to the processing of this data according to Article 21 GDPR, based on grounds relating to your particular situation or insofar as the objection is lodged against direct marketing. In the latter case you have a general right to object which will be upheld by us without your stating any particular situation. 8. Data security
During a visit to our website we use the commonly applied SSL procedure (Secure Socket Layer) in connection with the highest encryption supported by your browser. Typically this is a 256 bit encryption. Should your browser not support 256 bit encryption we will use 128 bit v3 technology instead. You can determine whether a particular page of our website is transmitted in encrypted mode by the key lock symbol in the status bar of your browser. We furthermore apply appropriate technological and organizational security measures to protect your data from accidental or deliberate manipulation, partial or complete loss and destruction or unauthorized access by third parties. Our security measures are continuously improved according to technological progress.

This privacy statement is currently applicable and is dated May 2018. Through the advancement of our website and the offers contained in it or through changed legal or administrative regulations it may become necessary to change this privacy statement.
